AI & Generated Content Policy
What OrderVora's AI features do, what their output can and cannot be relied on for, and who is responsible for it.
This Policy is part of the OrderVora Terms of Service. It explains how the AI-powered features of the Service work, what their output can and cannot be relied on for, and the responsibilities of a Merchant that uses them.
It is written for two readers. Merchants need to know what they are responsible for when they use these features. Customers need to know that some of what they see on a storefront may have been produced or assisted by AI.
1. Where AI is used in the Service
Depending on the plan and configuration, the Service uses artificial intelligence and automated processing to produce or assist with:
- product photographs and product images
- storefront, hero, category, and background imagery
- menu and catalogue data extracted from material a Merchant uploads
- product names, descriptions, and other written content
- categories, groupings, tags, and classifications of products
- information extracted from a photographed or scanned menu, a PDF, or a website
- prices read from uploaded material
- business details read from uploaded material, such as a name, address, or phone number
- suggestions, recommendations, and insights about a Merchant's business
- translations and rewritten or reformatted text
- answers, summaries, and actions produced by the AI assistant
- other generated text, data, and media
All of this is referred to here as "Generated Content", whether it was produced entirely by a model or produced with a model's assistance.
AI features are provided by third-party AI and machine-learning providers acting on our behalf. Their availability, behaviour, quality, and output can change without notice when a provider changes or retires a model. See the Terms and the Privacy Policy.
2. AI output is probabilistic
AI models generate a statistically likely output. They do not know facts, do not check them, and do not reason about the real world in the way a person does. The same input can produce different output on different runs.
Generated Content may, among other things:
- be inaccurate or simply wrong
- be incomplete, or omit information that was present in the source
- invent information that was never in the source, including plausible-sounding details that do not exist
- contain visual artifacts, distortions, or nonsensical detail
- misclassify or mis-categorise a product
- misunderstand or misread an uploaded menu, including its layout, structure, or which price belongs to which item
- misread prices, or produce a price that is wrong by an order of magnitude
- produce visually inaccurate details, or an image that differs from the actual product
- state or depict incorrect ingredients, components, portions, or presentation
- reflect a bias present in the model or its training data
- produce content that is unsuitable, off-brand, misleading, offensive, or unlawful to publish
- be out of date, or fail to reflect a change the Merchant has since made
To the maximum extent permitted by applicable law, OrderVora makes no warranty that Generated Content is accurate, complete, current, original, non-infringing, or fit for any purpose, and does not warrant that any particular output can be produced or reproduced.
3. AI-generated product images
OrderVora does not inspect any physical product, does not visit any Merchant's premises, and does not verify a generated image against the item a Merchant actually sells. No feature of the Service compares generated imagery to a real product. A generated image reflects the words used to describe an item — nothing more.
A Merchant that publishes a generated image is solely responsible for deciding whether it fairly represents the product, and for compliance with laws on advertising, marketing, and unfair or deceptive practices. A Merchant should not publish a generated image where an accurate depiction is legally required, where the difference would materially affect a Customer's decision, or where the image could mislead about quantity, portion, ingredients, or what is included.
Where a Merchant wants an image to reflect its real product, it should use its own photographs. Real photographs are always the safer choice, and the Service supports uploading them.
Customers: treat any product image on a storefront as illustrative unless the Merchant states otherwise, and contact the Merchant if what an item actually includes matters to you.
AI-generated product images may not represent the actual product with 100% accuracy
An AI-generated image is an illustration produced by a model from a text description. It is not a photograph of the item a Merchant sells, and it is not a photograph of the item a Customer will receive.
The actual product may differ in appearance, size, portion, quantity, ingredients, toppings, garnish, packaging, container, texture, colour, arrangement, plating, presentation, background, setting, and any other visual detail.
5. The AI assistant, insights, and suggestions
The Service includes an AI assistant that can answer questions about a Merchant's business, summarise data, make suggestions, and — where the Merchant asks it to — take actions in the Merchant's account.
The assistant can be wrong. It may misread data, misunderstand a request, summarise inaccurately, or suggest something inappropriate for the business. Its insights, benchmarks, projections, and recommendations are informational aids based on available data and on assumptions that may not hold. They are not business, financial, legal, tax, accounting, employment, food-safety, or regulatory advice, and they are not a guarantee of any result.
A Merchant remains responsible for reviewing what the assistant does and for every decision it makes on the basis of the assistant's output, including any action the assistant takes at the Merchant's request.
6. Merchant review is required before publishing
A Merchant must review Generated Content before publishing it, and must correct or remove anything inaccurate, misleading, off-brand, infringing, or unlawful.
This is the Merchant's obligation. The Service is a tool: generating content and applying it to a catalogue can happen in a few steps, and the Service does not independently review, verify, approve, or hold Generated Content for checking before it can appear on a storefront. Nothing in the Service should be understood as an editorial or compliance review by OrderVora — no such review takes place.
So a Merchant must not treat Generated Content as publication-ready simply because the Service produced it. In practical terms, before publishing a Merchant should check that every item is real and available, that every price is right, that descriptions match what is actually sold, that ingredient and allergen text is correct and complete, that categories make sense, and that images are a fair representation.
Once published, Generated Content is the Merchant's content and is treated as Merchant Content under the Terms. The Merchant is responsible for it exactly as it is for content it wrote itself, and it does not matter to a Customer, a regulator, or a court that a model drafted it.
7. Generated Content must not be relied on for high-risk determinations
Generated Content must never be the basis for a decision where being wrong causes harm or breaks the law. It must not be relied on for:
- allergen information, or any statement that a product is free from an allergen
- ingredient lists, recipes, or the actual composition of a product
- nutritional information, calorie counts, or health, dietary, or medical claims
- food safety, handling, storage, temperature, shelf-life, or sanitation decisions
- legal compliance of any kind
- tax treatment, tax rates, or tax decisions
- regulatory or licensing decisions, including whether a product may lawfully be sold
- age verification, identity verification, or any age-restriction decision
- any other determination where an error could affect a person's health or safety, or create legal exposure
For anything on that list, a Merchant must rely on its own verified information — its recipes, its suppliers, its specifications, its licences, and where appropriate its own professional advisers.
Allergen and ingredient information in particular must come from the Merchant's own knowledge of what it makes, never from generated text. A Customer with an allergy, intolerance, or dietary restriction should contact the Merchant directly before ordering and should not rely on catalogue text, tags, or images. 8. Rights in material submitted for AI processing
A Merchant must have all rights necessary to submit the material it uploads for AI processing, and by submitting it represents that it does. That includes photographs, menus, logos, brand assets, artwork, descriptions, and website content.
Do not upload material you do not have the right to use — for example another restaurant's menu, a photographer's image you have not licensed, a stock image outside its licence terms, a third party's brand assets, or content scraped from another site. A Merchant that does so is responsible for the consequences and indemnifies OrderVora under the Terms.
9. Intellectual property in Generated Content
The legal status of AI-generated output is unsettled and varies by jurisdiction. Purely machine-generated material may not be eligible for copyright protection, which means a Merchant may not be able to claim exclusive rights in a generated image or text or stop someone else from using something similar.
OrderVora does not warrant that Generated Content is original, that it is protectable, that a Merchant owns it, or that it does not resemble or conflict with a third party's intellectual property. Generative models are trained on large datasets, and output can coincidentally resemble existing work, a style, a trade dress, a logo, or a product. The Service applies guardrails intended to avoid producing recognisable third-party brands, but those are best-effort measures and not a guarantee.
A Merchant is responsible for satisfying itself that content it publishes does not infringe anyone's rights, and should not publish Generated Content that reproduces or closely imitates a recognisable brand, logo, character, or another business's distinctive presentation. Between OrderVora and a Merchant, and to the extent rights exist and are transferable, OrderVora does not claim ownership of Generated Content produced for that Merchant's own catalogue; OrderVora retains all rights in the Service, its models, prompts, templates, and art direction.
10. What we do with AI inputs
Material a Merchant submits to an AI feature is sent to a third-party AI provider acting on our behalf so the feature can work. We keep the input, the output, and a record of usage as described in the Privacy Policy, including for plan allowances and cost accounting.
We do not use Merchant business data or Customer personal information from the Service to train our own general-purpose AI models. Where we send input to a third-party AI provider, we seek to use their services on terms that do not permit training on our input; that provider's terms govern its own processing, and we cannot guarantee a third party's practices beyond what its terms commit to.
Do not submit information to an AI feature that you would not want processed by a third-party provider — in particular, do not submit personal information you do not need to, and do not submit payment card details, government identification numbers, health information, or credentials.
11. Usage limits and availability
AI features consume plan allowances — for example menu-import and image-generation credits — and are subject to rate limits and fair-use controls. Allowances by plan are shown in the Service.
AI features may be unavailable, degraded, slower than usual, or may fail, including because a third-party provider is unavailable, has changed or retired a model, or has refused a particular request. A generation may fail or return something unusable, and consumed allowance for a failed attempt is handled as described in the Service or the Refund & Cancellation Policy. OrderVora may change, limit, suspend, or discontinue an AI feature, and may impose additional restrictions where necessary to protect the Service, comply with a provider's terms, or comply with law.
12. Prohibited uses of AI features
A Merchant must not use the AI features of the Service to:
- create content that is deceptive or misleading about a product, its price, its ingredients, its origin, or what an order includes
- generate imagery intended to misrepresent portion size, quantity, or included items
- produce content that infringes or misappropriates another party's intellectual property, or that imitates another business's brand or trade dress
- generate false allergen, ingredient, nutritional, health, or safety claims
- produce content that is unlawful, defamatory, harassing, hateful, or sexually explicit, or that depicts a minor inappropriately
- generate false reviews, testimonials, endorsements, or other fabricated social proof
- produce content marketing a regulated product in a way applicable law prohibits
- attempt to extract, reverse engineer, or circumvent the Service's models, prompts, safety guardrails, or usage limits
- process material the Merchant has no right to submit
OrderVora may refuse, limit, or remove AI output, and may suspend access to AI features or to the Service, for a violation of this Policy or the Terms.
13. Disclaimer and allocation of responsibility
To the maximum extent permitted by applicable law, Generated Content is provided as-is, OrderVora disclaims all warranties in respect of it, and OrderVora is not liable for any loss arising from Generated Content or from a decision made in reliance on it — including inaccurate catalogue data, an incorrect published price, a misleading image, wrong ingredient or allergen text, or a business decision based on an AI insight. The limitation of liability and indemnification provisions of the Terms apply.
Nothing in this Policy excludes or limits liability that cannot be excluded or limited under applicable law.
14. Changes to this Policy and contact
AI capability moves quickly, and we expect to update this Policy as features and providers change. We will update the effective and last-updated dates above, and will take reasonable steps to notify Merchants of a material change.
